1. Agreement to Terms

By accessing or using ThumbForge at youraithumbnailgenerator.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use ThumbForge.

2. Description of Service

ThumbForge is an AI-powered thumbnail generation platform that creates professional YouTube thumbnail images from text descriptions. The Service includes:

• AI-powered image generation using Google Gemini Imagen and other models
• A browser-based canvas editor for text overlay and composition
• Platform-specific safe zone enforcement for YouTube, Shorts, and Reels
• Educational content through the Creator Academy guides
• Export functionality for downloading generated thumbnails

3. User Accounts

You may use limited features of ThumbForge without creating an account (one guest generation). To access full features, you must create an account through our Clerk authentication provider using Google OAuth or email/password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Intellectual Property Rights

You retain full ownership and commercial rights to any YouTube thumbnails generated using our Service. You may use these thumbnails for any lawful purpose, including commercial use on YouTube, social media, and other platforms.

By using the Free tier, you grant ThumbForge a non-exclusive, worldwide, royalty-free license to display your generated thumbnails in our public Community Gallery for promotional purposes. This license can be revoked by upgrading to Pro or by requesting removal via email.

The ThumbForge name, logo, and website design are the intellectual property of Haxceb Studios and may not be reproduced without permission.

5. Acceptable Use Policy

You agree not to use ThumbForge to generate content that:

• Is illegal or promotes illegal activities in any jurisdiction
• Violates YouTube's Community Guidelines, including misleading clickbait or explicit content
• Infringes on the intellectual property, trademark, or copyright of others
• Contains hate speech, harassment, or content that promotes violence
• Impersonates another person or entity
• Attempts to exploit, abuse, or circumvent our rate limiting or security measures

We reserve the right to suspend or terminate accounts that violate this policy without prior notice.

6. Subscriptions & Payments

ThumbForge offers a free tier and a paid Pro tier ($9.99/month). If you purchase a Pro subscription:

• You agree to pay all fees in accordance with the pricing displayed at the time of purchase
• Subscriptions automatically renew monthly unless cancelled before the renewal date
• You may cancel your subscription at any time; Pro features remain active until the end of the billing period
• Refunds are available within 7 days of the initial purchase if you are unsatisfied with the Service
• We reserve the right to change pricing with 30 days advance notice to existing subscribers

7. AI-Generated Content Disclaimer

Thumbnails generated by ThumbForge are created using artificial intelligence models. While we strive for high-quality, relevant outputs, we cannot guarantee that every generation will meet your expectations. AI-generated images may occasionally contain artifacts, inaccuracies, or unexpected content. You are responsible for reviewing all generated thumbnails before publishing them.

8. Service Availability

We strive to maintain 99.9% uptime for the ThumbForge Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control (such as third-party API outages from Google Gemini or authentication providers).

9. Limitation of Liability

To the maximum extent permitted by law, ThumbForge and Haxceb Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, for significant changes, by posting a notice on the Service. Your continued use of ThumbForge after changes constitutes acceptance of the revised Terms.
